About 12 h 57 min of reading46 chapters

George Elliott Howard's History of Matrimonial Institutions, published in three volumes in 1904, was the first large-scale study of marriage and divorce law in England and the United States. This first volume opens with the theories of primitive marriage, the patriarchal theory of Maine, the mother-right of Bachofen, the constructions of Morgan and McLennan and the criticisms of Westermarck, then traces the rise of the marriage contract through wife-capture, wife-purchase and free marriage, and the early history of divorce. The second half turns to England: the Old English and medieval wedding, the canon law, child marriages in the age of Elizabeth, Cromwell's civil marriage act of 1653, the Fleet marriages and Lord Hardwicke's Act of 1753. The full text is available to read online in your browser on Vinteuil, and the first chapter is free.
